Child Custody
When adopting a foreign child concerned should follow the same steps and I discussed for adoption in our country, but more will have to present a series of new travel documents and the child’s country of origin and period of collection adaptation.
We look at everything and we tell you what’s new:
- The first is to request information on organisations dedicated to fostering and adoption of the Autonomous Community.
- To then submit an application, accompanied by the following documents:
- Birth Certificate applicants.
- Marriage certificate or, alternatively, coexistence.
- Certificate of Registration.
- Documents evidencing stable and sufficient income for child support (payroll, personal income tax last statement, statement of heritage ….)
- Declaration of the existence or not, biological or adopted children.
- Medical certificate. You must include a report of psychological and mental health of the adoptive parents and not have to prove that infectious diseases such as AIDS or hepatitis B.
- Documents to medical care.
- Criminal record.
- Photocopy of passport and two passport photos of each applicant.
After those interested should contact Social Services for autonomous, to obtain a qualification certificate. This document, which is essential for making protected by law, requires that prospective adoptive parents overcome a study to be subjected to interviews to assess their capabilities as prospective adoptive parents.
Once in possession of these documents forwarded to the Committee on Guardianship of Minors.
What must be added in case of international adoption
Documentation to be included in the request for adoption:
- Notarial whereby applicants agree to accept a child of foreign nationality in accordance with the laws of the country of origin as well as to recognise him as her son for legal purposes.
- Power of Attorney in favour of lawyers who will act in the country of adoption.
- Copy of passport.
Send the certificates and reports cited the Ministry of Foreign Affairs, handed over, later in the consulate of the country chosen. Typically, international procedures are performed through an ECAI (Collaborating Organisation for International Adoption) accredited by the autonomous region.
Once assigned the child:
* Travel the country to pick it up and stay there about one month adjustment period for your child.
* Register the adoption in the Register of the Spanish consulate and obtain the child’s passport.
* Once in Spain, you must enrol the new family member in the Civil Registry.
